It was approved Wednesday by the House Judiciary Committee, which is examining the so-called "Decree-empty prisons", proposed by the government, an amendment that prevents people detained and who do not have access to a home under house arrest. L'emendamento, formulated by Mr Matthew Brigandì (Northern League), will have an effect detrimental to the rights of homeless people, denying them the use of the cardinal measure of the decree, or the ability to serve out the last year of prison sentence.
Already today, the use of house arrest is problematic for people who are homeless or severely marginalized who are incarcerated. But the amendment approved by the Commission ends up adopting this state of affairs, transferring the inability on the floor of the right, limited to once again use a lever repressive to solve a social problem, ignoring the constitutional principle of the rehabilitative purposes of punishment, and establishing that there are people for whom it is permissible to suspend opportunity afforded to ordinary citizens, by virtue of their state of severe marginalization.
The amendment by Mr Brigandì likely to suppress, in practice, also the possibility - until now scheduled for the homeless - to serve the ultimate penalty period at a place, public or private, that functions as a care, welcome and assistance. The alternative treatment, in other words, would be extended and made systematic in the last year of detention, but only in the home of convicted. The enormous difficulties related to the absence of dwelling, often the root of the offense that led the person to prison, Therefore, it would add further discrimination, not necessary and, paradoxically able to confirm that the person suffers in a role and a "career" criminal.
'Again, determined by the choices that have to do with the management of public order - says Paolo Pezzana, President of FIO.psd, on behalf of the new Board of Directors of the Federation, meeting in Genoa in planning the work of the next three years -, loom measures that have no other effect than to discriminate against vulnerable, weakening the degree of cohesion of the social fabric without increasing the degree of security. Fio.PSD, feeling of giving a voice to 74 participating institutions (associations, social cooperatives, community, pastoral organizations, operating in 13 regions and 25 provinces of Italy), criticizes this approach and the choice taken by the House Judiciary Committee. It is hoped that the decision will be reversed in the subsequent parliamentary procedures, declared its willingness to interact with the institutional realities, to find solutions that satisfy the needs for reform of the penitentiary system, security needs of the community, prisoners' rights and social reintegration of persons severely marginalized ».
