Identity Theft, here's what threatens those who live in the street

"Street lawyer" is established in Bologna in 2000. How did the idea and how you organized on the national territory?
"Street lawyer" was created to protect the rights of people living on the streets and help them return to a life in common. Those who live in the street, a series of legal issues that can be solved only with the help of a lawyer. In Italy, the law provides that those who have an income of less than 10600 euro per year can apply for legal aid, or a lawyer who works for free and that is paid by the State. All the homeless have an income below this figure, but they can not ask the question because they do not have papers and are free of residence. Street lawyer was developed to fill this gap. Oggi siamo presenti in oltre trenta città italiane e ogni nostra sede è organizzata come un vero e proprio studio legale.

Who are the people who work at your doors and how you can become "Street lawyer"?
Our association is made up of about 700 professional lawyers who have decided to put at the service of the weakest a small part of their time. Lawyers are joined by other volunteers, pensioners, young practitioners, law students, dealing with secretarial tasks, accompaniments of the assisted, etc.. You can draw a sketch of the people who come to you?
At one time the homeless 'type' was grown man, only and do not attend school, that before ending up on the street had been in jail or in a community for drug addicts. The economic crisis and the loosening of social and family ties have changed things: we find men and women in the street, young and old, Italian and foreign. Finally in the street may be sufficient the occurrence of a simple event that all in life have had to deal with: a bereavement, a separation, an illness or the simple loss of a job: se non ci sono amici o familiari a sostenerci le porte della strada si possono aprire per chiunque.

In 2012 "Street lawyer" has assisted 2.575 people. Can you tell us a story particularly significant and representative?
I want to cite a case that we are following these days: a man who lived in the street in Modena appeared to be unknown to him owner of a car that has been used for a robbery, and for this he had to undergo a process. That identity theft is a case that we face often: to unsuspecting homeless are headed machines, companies and licenses, because being without residence can not be found easily. Our assisted had given in good faith his identity papers two fraudsters who had promised him a job: the PM asked for his acquittal and the judgment will be released in the coming days: teniamo le dita incrociate.

Among the rights denied to homeless people, always report the right to legal residence. Why?
The one for my residence is one of our battles 'historical'. Those who live on the street sooner or later end up losing the home and those who have no residence can not vote, can not open a VAT, can not have a council house, can not receive a pension even if they have the right, is not entitled to social services and, very serious thing, does not have access to the national health system if not for the accident and emergency medicine. In our country, my residence is so important that everyone be guaranteed by the Constitution. The problem is that those who should enforce this law, and that the City, often opposes the resistance because it is believed that granting the residence then it means having to bear a number of charges. In fact the opposite is true: a person who does not reside is doomed to remain in limbo pure welfarism, mentre a partire da quel diritto può cercare di ricostruire la propria vita.

Through this partnership, Elsa Italy and Street lawyer will be able to work together to:

(a) organize seminars and / or conferences, and promotion and / or sensitization or other joint activities designed concert on rights issues and social exclusion;

(b) to connect students and young graduates who wish to get involved in volunteering or legal secretarial tasks at the doors of Street lawyer;

(c) publicize the activities of the same in their message boards and websites;

(d) pursue common ideals and principles, supporting Street lawyer in communication campaigns, to design and implement national projects such as joint, limited:

(a) awareness campaigns,

(b) legal research projects, to spread in bookstores, libraries, between lawyers, institutions and private citizens interested, tra cui gli studenti.

The death of Don Andrea Gallo affects us deeply. A po’ because for many years, like all those who deal in Italy of the weakest, Don looked at Andrew as a shining example, to follow and imitate, always “in the obstinate and contrary”.

A po’ because, an unfortunate and almost incredible coincidence, Next Saturday we had to inaugurate the new headquarters of Street lawyer in Genoa, that would have been hosted by his own association, the Community of San Benedetto al Porto.

After months of meetings and exchanges we had long-delayed presenting this new collaboration that thrilled all of our volunteers because we hoped that Don Andrea could be with us. Unfortunately, things did not go as we would have liked.

The great family of Don Andrea and people close to him is all our love and a promise: with our activities for the defense of the rights of the last, in Genoa as in other cities, cercheremo di fare ancora di più e meglio per essere all’altezza del suo ricordo.

The initiative, organized within the project "Rights-south", was held on Friday 17 May 2013 at the University of Salerno and is accredited by the Council of the Bar of Salerno for n. 3 crediti formativi.

Back to top “The Scream Of The Butterfly”, free information meeting, organized by the "Group of Sugar", in collaboration with the Municipality of Ravenna. Il meeting, now in its 5th edition, will be held at the Piazza San Francesco in Ravenna and provides numerous meetings by 16 to the 19 maggio.

Radio Vaticana: “Over 2500 in 2012 assisted the association “Street Lawyer”

Over 2500 Italian citizens, and outside the EU were assisted in 2012 by the "Street lawyer". And 'what emerges from the annual report of this non-profit association. There was a significant increase in the practices of migrants as a result of the emergency North Africa, with the arrival of people from Tunisia and Libya, as confirmed by the president of the Antonio Mumolo, al microfono di Elisa Sartarelli.

R. - The fact that we face many of these issues also tells us that has changed the types of people who are on the road. Today in the street there are people who do not have these problems. The number of Italians in the last three years has doubled. There are people in the street who simply have become poor and that they would never expect to end up on the street. There are, then, separated fathers, bankrupts, artisans who have had to close, workers 50 Years fired, pensioners at least we do not make more to pay rents, bills and if you do not have people around end up in the street. Against the other, are the most difficult to help, because they are ashamed of this situation. The increase of those practices, relating to residence and work, is the result of this new situation. D. - And 'fair to say that many homeless people prefer to stay without residence and without rights, because their dependents are increasing debts, due to non-payment of taxes and duties?

R. - As far as our experience, this is true of relatively, why stay without residence means you have no rights and no chance to embark on a career path. Without residence, in fact, you can not work, can not be a pension, even if you have the right to that pension, and you can not take advantage of the National Health Service. We have done a lot of practice on the residence, because it is an individual right, subjective, which must be protected, so that with these practices we were able to bring out many people from the street. Sure, when a person takes up residence, if you have debts, the lender may ask them to him. It 'something, but, highly, very relative. Meanwhile,, because if one has no money and lives in a dorm or on the road, one can not ask anything, but you do not get any results, not avendoceli. D. - How do you manage to let you know by now people on the margins of society and its communication channels?

R. - We open a door to the street lawyer only within voluntary associations secular or Catholic, but you actually occupy the homeless. The association, then, acts as an intermediary between the door, which is a low-threshold service, unfiltered and open to all, and the road. Also, when we open a door, the open part of an association, but it is a service for the entire city, for social services and for all other associations and, when we open, search in our small to advertise this event, organizing a public presentation of the door as a lawyer street, and urging all local voluntary associations that deal with homeless people. Increase attacks on homeless, the new poor targeted by bullies
